UAE Regulator Fines Foreign Bank Branch AED 200 Million

The Central Bank of the UAE (CBUAE) has taken a major step in enforcing anti-money laundering and counter-terrorism financing (AML/CFT) regulations, fining a branch of a foreign bank AED 200 million. This move is part of the regulator's efforts to ensure that banks operating in the UAE comply with the country's laws and regulations. The fine is a result of the bank's serious and repeated failures in its AML/CFT framework.

The CBUAE's inspections revealed significant weaknesses in the bank's governance, compliance, and sanctions controls. These failures led to the regulator taking action not only against the bank but also against two senior officers. The chief executive officer was fined AED 500,000, while the head of compliance, who also serves as the money laundering reporting officer, received a fine of AED 300,000. According to the CBUAE, both officers failed to perform their duties adequately.

What the penalties entail

As part of the penalties, the bank is required to implement a mandatory remediation programme, which will be monitored by an independent party. Additionally, the bank's chief executive officer and chief compliance officer will undergo a new assessment to determine their suitability for their roles.

The CBUAE's actions are governed by the federal law that regulates the central bank and the financial institutions under its supervision. The regulator's primary goal is to protect the integrity and transparency of the banking sector and the broader financial system in the UAE.

Why it matters for the UAE

The CBUAE's decision to fine the foreign bank branch AED 200 million sends a strong message to banks operating in the UAE. It emphasizes the importance of complying with the country's AML/CFT regulations and the consequences of failing to do so.
